Privacy policy for lead generation forms

This policy explains how SOEN processes personal data received through lead generation forms, including those published on LinkedIn.

1. Identity of the data controller

SOEN S.A.C., tax identification number (RUC) 20601392063, with registered address at Av. Arequipa 2447, Lima, Peru, hereinafter “SOEN”, is responsible for processing personal data collected through its lead generation forms, including forms published on LinkedIn.

2. Personal data collected

Through its forms, SOEN may collect personal data voluntarily provided by the user, including:

  • First and last name.
  • Personal or business email address.
  • Telephone number.
  • Job title or position.
  • Company name.
  • Industry or business activity.
  • Company size.
  • City or country.
  • Information voluntarily included in form responses.
  • Information related to the service or solution of interest.

3. Purposes of processing

3.1. Responding to the request

SOEN will use the data to respond to the request voluntarily submitted through the form.

  • Respond to requests for information, inquiries, assessments or quotations.
  • Contact the user by email, telephone, WhatsApp or another provided channel.
  • Identify the user's business needs.
  • Prepare and present commercial proposals related to the request.
  • Follow up on the inquiry.

3.2. Marketing and advertising communications

When the user provides specific consent, SOEN may also use the data for the purposes below. This consent is optional, and refusing it will not prevent SOEN from responding to the user's primary request.

  • Send information about technology products, services and solutions.
  • Communicate promotions, campaigns, news and commercial content.
  • Invite the user to events, webinars, demonstrations or activities organized by SOEN.
  • Send newsletters and informational content.
  • Conduct commercial or satisfaction surveys.

5. Required data

Fields identified as required are necessary to respond to the user's request. If this information is not provided, SOEN may be unable to answer the inquiry, prepare a quotation or provide the requested information.

Data and consent related exclusively to advertising communications are optional.

6. Storage and retention

Personal data may be incorporated into the applicable personal data bank owned by SOEN and, where required, duly registered with Peru's National Registry for the Protection of Personal Data.

Data will be retained only for as long as strictly necessary to respond to the request and fulfill the stated purposes. It may be retained for a longer period when there is a contractual or commercial relationship, a legal obligation, valid consent for marketing communications or a need to address liabilities arising from the processing.

SOEN will delete or anonymize data when it is no longer necessary and no legal obligation justifies its retention.

7. Processors and recipients

SOEN may grant access to personal data to providers that deliver services necessary for its operations. These providers will process data only under SOEN's instructions and subject to confidentiality and security obligations.

Personal data will not be sold, rented or otherwise commercialized. It will not be shared for purposes other than those stated unless the data subject provides consent or a competent authority requires disclosure.

  • Hosting and technology infrastructure.
  • Customer relationship management or CRM.
  • Email and communications.
  • Analytics, automation and marketing.
  • IT support and security.

8. LinkedIn

Some forms are made available through LinkedIn. LinkedIn may process information in accordance with its own terms and privacy policy.

Once the user submits a form and SOEN receives the information, SOEN is responsible for its subsequent processing in accordance with this Privacy Policy.

9. International transfers

Some technology providers used by SOEN may store or process information on servers located outside Peru.

Where applicable, SOEN will take the necessary measures to ensure an adequate level of protection and compliance with applicable Peruvian law.

10. Security and confidentiality

SOEN applies reasonable technical, organizational and legal measures to protect personal data against loss, alteration, unauthorized access, disclosure or improper processing.

Access to personal data is limited to personnel and providers who need it to fulfill the stated purposes.

Data subjects may exercise the rights recognized under Peruvian law, including:

To exercise these rights, send a request to contacto@soen.pe stating your full name, the right you wish to exercise, a clear description of the request, a document that verifies your identity, information that helps locate your data, and an address or email for the response.

If you believe that your request was not properly addressed, you may contact Peru's National Authority for the Protection of Personal Data.

  • Information: learn the conditions and purposes of processing.
  • Access: request information about the personal data being processed.
  • Rectification: correct inaccurate, incomplete or outdated data.
  • Cancellation: request deletion of data where applicable.
  • Objection: object to processing on legitimate grounds.
  • Withdrawal: withdraw previously granted consent.

12. Minors

SOEN's forms are intended for adults and company representatives. SOEN does not intentionally seek to collect personal data from minors through these forms.

13. Changes to this policy

SOEN may update this Privacy Policy due to legal, regulatory, operational or technological changes. The current version will be published on this page together with its latest update date.

14. Applicable law

The processing of personal data is governed by Peru's Personal Data Protection Law No. 29733, its Regulations approved by Supreme Decree No. 016-2024-JUS, and other applicable provisions in Peru.
